Premier Lesufi unveils mandate of Commission of Inquiry into Marshalltown fire -13 September 2023

Premier Panyaza Lesufi has emphasised that the work of this Commission would be separate from that of the South African Police Services (SAPS) in the investigations surrounding the fire at the Usindiso Building. 

The incident, which occurred on 31 July 2023, claimed the lives of at least 77 individuals, leaving many injured and homeless.

Premier Lesufi appointed the Commission of Inquiry on 4 September 2023, in accordance with the provisions of section 127 (2) (e) of the Constitution, read in conjunction with section 2 of the Provincial Commissions Act, 1997 (Act No.1 of 1997).

During a press conference held at the Gautrain Management Offices in Midrand, Premier Lesufi articulated the primary objectives of this commission.

Addressing the media on Wednesday at the Gautrain Management Offices in Midrand, Premier Lesufi stressed the need for a comprehensive investigation to uncover all potential factors contributing to the tragic incident.

"We felt that a complete and comprehensive probe was necessary to mitigate the chances of something similar happening again.

"It will be allowed to conduct its work without any undue political interference from anyone and will be given all the necessary logistical support by the Gauteng Provincial Government," said Lesufi.

The commission's work will be carried out in two distinct phases. The first phase will examine the circumstances surrounding the Usindiso Building, while the second phase will focus on determining accountability for the resulting loss of life and injuries. Furthermore, the Commission will make recommendations regarding necessary actions and responsible parties, addressing all pertinent matters within the scope of the inquiry.
Premier Lesufi provided a timeline for the commission's work, stating the initial phase of the investigation will commence on 1 October 2023 and conclude on 30 November 2023. He added that the commission will submit its report on the first phase of the inquiry to him by 30 December 2023. 

"The second part of the investigation will commence on 1 January 2024 and end on 31 March 2024. The Commission will then prepare and submit a report with the second part of the investigation before or by 30 April 2024," said the Premier.

The commission comprises distinguished members, with retired Constitutional Court Judge Honourable Judge Sisi Khampepe serving as the Chairperson, supported by Advocate Thulani Makhubela and Vuyelwa Mathilda Mabena.

Seanego Attorneys Incorporated has been appointed as the designated law firm responsible for assigning one of its directors or partners as the secretary to the commission.
