Maile appoints top advocate to investigate corruption in Sedibeng Municipality - 18 August 2020

Gauteng MEC for Human Settlements, Urban Planning and Cooperative Governance and Traditional Affairs, Lebogang Maile has taken the Sedibeng Municipality to task with the appointment of top advocate to investigate allegations of corruption, maladministration, financial mismanagement and acts of nepotism levelled against the municipal manager, Stanley Mukhari and the municipality.

In July, MEC Maile wrote to the Mayor of Sedibeng, Busi Modisakeng urging that she sends him a written representation on the allegations and corrective measures taken by the municipality to address them.

Following the results of the representations received from the Municipality, MEC Maile, then deemed it necessary to appoint an investigator to conduct an independent investigation.

Advocate William Mokhari SC was appointed in accordance with Section 106(1)(b) of the Local Government Municipal Systems Act No. 32 of 2000, as amended, to conduct the investigation into all the allegations levelled against the Municipal Manager of Sedibeng District Municipality and the Municipality.

Should Adv Mokhari SC find that the allegations are indeed substantiated he is empowered to make recommendations on the appropriate sanction, if any. Adv Mokhari SC is required to issue his findings and report to the MEC within 21 days from the date of his appointment. 

Should the need arise, the MEC may extend the period of appointment.

MEC Maile has further called on the municipality to fully co-operate with Mokhari's investigation.

"It is necessary for all parties involved to fully cooperate with the investigation," he said.

Maile has duly briefed the National Council of Provinces and the Ministers of Co-operative Governance and Traditional Affairs and Finance on the decision taken.

MEC Maile said he is committed to rooting-out acts of impropriety, maladministration and corruption across all municipalities, irrespective of the party in office, in the interest of improved service delivery
