RE-ADVERTISEMENT – MEMBERS OF THE ADJUDICATION PANEL

Gauteng Department of Human Settlements (GDHS)

Assets Disposal and Regularisation Directorate (ADARDI)                            ________________________________________________________________________


Suitable applicants are hereby invited, to be appointed as Adjudicators on the panel for ADARDI, in assisting and resolving various disputes emanating from transfer of state-subsidised properties, within the GDHS as well as those situated at local authority level. The panel will be contracted over a period of three years (on an ‘as and when required’ basis).

1. Legally qualified, successful individuals should have knowledge of housing and associated statutes and policies including but not limited to: the Conversion of Certain Rights into Leasehold Or Ownership Rights Act, Act 81 of 1988; the Gauteng Housing Act of 1997; Guidelines for the Identification of the Rightful Housing Subsidy Beneficiaries to enable Transfer of Subsidy Scheme Properties, 2016 (REGPOL); the Enhanced Extended Discount Benefit Scheme as well as Gauteng General Laws Amendment Act 4 of 2005.

2. Applicants with demonstrable practice in the areas of Succession / Family Law especially Administration of Estates; as well as Conveyancing will be prioritised.  

3. A demonstrable track record in the Alternative Dispute Resolution and / or Arbitration practice is a key requirement for this assignment.

4. Preference will be given to applicants in the Youth and Female categories as per the provincial empowerment objectives.

5. Applicants must apply as individuals (Practicing Attorneys / Advocates) and strictly be in good standing with the Legal Practice Council.

 

Upon appointment the applicants will, amongst others, be responsible for:

  • Conducting hearings/adjudication process in a transparent, efficient, fair and uniform approach in terms of Adjudication Regulations 2001 (pre-appeal and appeal matters);
  • Calling witnesses to give evidence, if deemed necessary for the resolution of the dispute;
  • Subpoena of witnesses by serving a notice, as appearing in Schedule 2 of the regulations, to give evidence or produce documents in disputed matters;
  • Drafting and presenting judgements that are legally binding on the parties involved;
  • Assisting with High Court matters in relation to housing disputes;
  • Attending to wrong registrations where necessary.

    Compensation for the service will be in line with the prescribed rates as determined by relevant statutory bodies.

    Adjudication (Hearings) will be held at centralised (Johannesburg) and de-centralised areas (Ekurhuleni, West Rand and Emfuleni).
